These Terms and Conditions of Use (the “Terms of Service”) apply to the websites owned or operated by Wilderborne LLC, currently located at www.wilderborne.com.

YOU ACKNOWLEDGE AND AGREE THAT BY BROWSING OR USING THE SITE, YOU HAVE AGREED, WITHOUT LIMITATION OR QUALIFICATION, TO BE BOUND BY THESE TERMS OF SERVICE AND ANY ADDITIONAL TERMS THAT MAY APPLY.  If you do not agree with these Terms of Service, please do not use the Site.

Wilderborne LLC reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Service, at any time, consistent with applicable law. It is your responsibility to check these Terms of Service periodically for changes. Wilderborne LLC will post a notification on this site or otherwise provide notice to you if these Terms of Service materially change.  Such changes, whether in the form of modifications, additions, or deletions, shall become effective when specified in the relevant notification.  If you do not agree to the changes, do not continue to use this Site after the date they become effective.  Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms of Service, Wilderborne LLC grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.

1. Content & Intellectual Property

All articles, text, hidden text within source code, graphics, user interfaces, visual interfaces, photographs, videos, trademarks, logos, music, sounds, and computer code (collectively, “Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of such Content, contained on the Site is owned by Wilderborne LLC or its licensors, and is protected by U.S. and international intellectual property and proprietary rights.

All trademarks appearing on these Site are the property of their respective owners, including, in some instances, Wilderborne LLC.  Nothing contained on these Site should be understood as granting you a license to use any of the copyrights, trademarks, service marks, or logos owned by Wilderborne LLC or by any third party.

When accessing this Site, you agree to obey the law and to respect the intellectual property rights of Wilderborne LLC.  You agree that you shall be solely responsible for any violations of any applicable laws and for any infringement of third-party rights caused by any Feedback (as defined below), User Content (as defined below), and PII (as defined below) that you provide or transmit to us.

All materials contained or distributed in these Site (the “Materials”) are owned by Wilderborne LLC.  You must not reproduce, modify, copy, publish, transmit, prepare derivative works based upon, distribute, perform or display the Materials without first obtaining the written permission of Wilderborne LLC and, if applicable, any other copyright owner.  You acknowledge that you do not acquire any ownership rights by downloading or printing the Materials.  Materials may not be used in any unauthorized manner.

2. Your Use of the Site; Restrictions

You may browse this Site and all associated content solely for your personal use and enjoyment.  Except as expressly provided in these Terms of Service, no part of the Site may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, sold, distributed, or otherwise exploited in any way (including, but not limited to, by “mirroring”) to any other computer, server, website or other medium for publication or distribution or for any commercial enterprise, without Wilderborne LLC’s express prior written consent.

You may not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Site, or in any way reproduce or circumvent the navigational structure or presentation of the Site, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available to you through the Site. You may not attempt to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site or to any server of Wilderborne LLC, or to any of the services offered on or through the Site, by hacking, password “mining” or any other illegitimate means.

You may not probe, scan or test the vulnerability of the Site or any network connected to the Site, nor breach the security or authentication measures on the Site or any network connected to the Site. You may not modify, reverse engineer, decompile, disassemble, reduce or attempt to reduce to a human-perceivable form any of the source code used in providing these Site, trace or seek to trace any information on any other user of or visitor to the Site, or any other customer of Wilderborne LLC, to its source, or exploit the Site or any service or information made available or offered by or through the Site, in any way where the purpose is to reveal any information, including but not limited to PII , other than your own information, as provided for by the Site.

You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or Wilderborne’s systems or networks, or any systems or networks connected to the Site or to Wilderborne LLC.

You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any transaction being conducted on the Site, or with any other person’s use of the Site, including, but not limited to, by interfering or attempting to interfere with service to any visitor, host, or network, such as by means of submitting a virus or any other harmful component to these Site, or by overloading, “flooding,” “spamming,” “mail bombing,” or “crashing” these Site.  In addition, you agree not to use these Site to send unsolicited e-mail, including, without limitation, promotions, or advertisements for products or services.  You also agree not to frame or utilize framing techniques to enclose any aspect of this Site, such as any trademark, logo, or other proprietary information (including, but not limited to, images, text, page layout, or form), or to use any metatags or any other “hidden text” utilizing Wilderborne LLC’s name or trademarks without Wilderborne LLC’s express written consent.

You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to Wilderborne LLC on or through the Site or any service offered on or through the Site. You may not pretend that you are, or that you represent, someone else, or impersonate any other individual or entity.

You may not use the Site, including, but not limited to, any Content or Materials contained therein, for any purpose that is unlawful or prohibited by these Terms of Service, or to solicit the performance of any illegal activity or other activity which infringes the rights of Wilderborne LLC or others.  Without limiting the generality of any terms or conditions set forth herein, in using the Site, you may not transmit or solicit: (a) any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane or indecent information of any kind, including images and language; (b) any message that constitutes, or encourages or incites conduct that would constitute, a criminal offense or gives rise to civil liability; or (c) any information, software or other material which violates or infringes upon the rights of others, including material which is an invasion of privacy or publicity rights or which is protected by copyright, trademark or other proprietary right, or derivative works with respect thereto, without first obtaining permission from the owner or right holder.

Any violation of Wilderborne LLC’s system or network security may subject you to civil and/or criminal liability.

3. Feedback & User Content

Any feedback, suggestions, questions, comments, ideas, notes, concepts, and other similar information relating to the Site or Wilderborne LLC that you provide to Wilderborne LLC (but excluding your PII) (collectively, “Feedback”) is deemed to be Wilderborne LLC’s proprietary information.  Wilderborne LLC may use such Feedback for any purpose, including, but not limited to, improvement and modification of the Site, and Wilderborne LLC shall own all rights, title and interest in and to the Feedback and such improvements and modifications.

This Site may contain interactive features that allow users to post, submit, publish, display, or transmit content and materials, including, but not limited to, photos, videos, other creative transmissions (“User Content”).  All User Content must comply with the standards set out in these Terms of Service.  By providing any User Content on this Site, you hereby grant to Wilderborne LLC, and each of their respective licensees, successors, and assigns a non-exclusive, irrevocable, unrestricted, perpetual, transferable, worldwide and royalty-free and fully paid-up right and license to use, reproduce, modify, perform, display, distribute, and otherwise exploit the User Content for any purpose.  You represent and warrant that you own or control all rights in and to the User Content and have the right to grant the license granted above to Wilderborne LLC, and each of their respective licensees, successors, and assigns.  Wilderborne LLC is not responsible or liable to any third party for the content or accuracy of any User Content posted by you or any other user of the Site.

The terms “Feedback” and “User Content” do not include any personally identifiable information, such as your name, e-mail address, physical address, and phone number(s) (collectively, “PII”) that you may provide to Wilderborne LLC, and which is subject to the privacy standards set forth in Wilderborne LLC Privacy Policy.  To access parts of this Site or some of the resources it offers, you may be asked to provide certain information, including, but not limited to, PII.  It is a condition of your use of this Site that all the information you provide on this Site, including, but not limited to, PII, is correct, current and complete.

4. Purchases; Other Terms and Conditions

Additional terms and conditions may apply to purchases of goods or services and to specific portions or features of the Site, including, but not limited to, contests, promotions or other similar features (as further described in Section 5 below), all of which terms are made a part of these Terms of Use by this reference. You agree to abide by such other terms and conditions, including where applicable representing that you are of sufficient legal age to use or participate in such service or feature. If there is a conflict between these Terms of Service and the terms posted for or applicable to a specific portion of the Site or for any service offered on or through the Site, the latter terms shall control with respect to your use of that portion of the Site or the specific service.

All prices, discounts, and promotions posted on this Site are subject to change without notice.  Wilderborne LLC may, from time to time, offer promotions or other discounts on product purchases.   Wilderborne LLC reserves the right to suspend any such promotions, update product information and change prices at any time without notice.  Furthermore, Wilderborne LLC reserves the right to change, limit, refuse, or cancel any order you place at our sole discretion.  Wilderborne LLC strives to display accurate price information; however, the Site may, on occasion, make inadvertent typographical errors, inaccuracies, or omissions related to pricing and availability.  Wilderborne LLC reserves the right to correct any errors, inaccuracies, or omissions at any time, and to cancel any orders arising from such occurrences.

Terms of payment are within Wilderborne LLC’s sole discretion and, unless otherwise agreed in writing, payment must be received before Wilderborne LLC’s acceptance of an order.  Currently, you may make purchases through the Site conditioned upon your agreement that your method of payment and payment information are processed via Squarespace Payments, and therefore, Wilderborne LLC does not take responsibility for your payment information.  Nonetheless, by entering into any transaction through the Site, you warrant and represent that all information you provide is true, correct, and complete (including, without limitation, your credit card information and billing address); that any credit card transactions submitted by you are authorized; that charges incurred by you will be honored by your credit card company; that you will pay charges incurred by you at the posted prices; and that you are the legal holder of any credit card or payment account used to enter into any transaction through the Site.

If Wilderborne LLC determines, in its sole discretion, that you have engaged in an improper transaction, Wilderborne LLC reserves the right to immediately terminate any pending transactions, suspend your access to the Site, and terminate all of Wilderborne LLC’s obligations hereunder.

By agreeing to the Terms of Service, you consent that the payment processing services for products purchased on this Site are processed via Squarespace Payments.

Return and Exchange Policy

If you are not satisfied with your purchase, or if it turns out that it’s just not what you were looking for, eligible items can be returned. Please read our Return & Exchange Policy carefully:

  1. To return or exchange a product, it must be unused, clean, and in NEW condition with all original tags attached and undamaged product packaging.

  2. Eligible items must be returned within 30 days of the original purchase date. We provide free return and exchange shipping on full-price items purchased in the lower 48 states. Free returns are not available for Alaska, Hawaii, or Canada. Shipping is non-refundable.

  3. You must obtain a return authorization number before returning your product(s). Upon approval and issuance of your return authorization number, items purchased at MSRP will be provided a printable UPS Ground return label. Return instructions will be provided for all eligible returns that do not qualify for a free return label.

Refund Policy

  1. In the event of cancellation of an event by Wilderborne LLC, a full refund will be issued.

  2. In the event of rescheduling of an event by Wilderborne LLC, we will reach out to attendee’s if the new date and time is satisfactory for their attendance. If not, a full refund will be issued.

  3. All individual event purchases will require a 25% non-refundable deposit at the time of booking. The additional 75% of the booking cost will be required at a minimum of 14 days prior to the event date. If an event deposit is paid, and the remaining booking cost is not paid at a minimum of 14 days prior to the event date the attendee will be removed from the event unless otherwise agreed upon by the sole discretion of Wilderborne LLC.

  4. All group event purchases (services being performed by Wilderborne LLC for a collective of individuals) 25% non-refundable deposit at the time of booking for the entirety of the event cost (cost of the collective group). If an event deposit is paid, and the remaining booking cost is not paid at a minimum of 14 days prior to the event date the event will be cancelled unless otherwise agreed upon by the sole discretion of Wilderborne LLC.

5. Sweepstakes, Contests, and Promotions

Notwithstanding the foregoing, ownership and use of all User Content, Feedback, and PII submitted in connection with a sweepstakes, contest, giveaway or other promotion (“Promotion”), shall be subject to the applicable Promotion’s “Official Rules” or other terms of service.  If you participate in a Promotion, such terms of service, may, for example, permit Wilderborne LLC to contact you to verify your eligibility, use your physical address for the purposes of prize fulfillment, share your PII with third parties providing services in connection with such Promotion or for purposes of prize fulfillment, and/or use other information submitted with your entry for future marketing, such as to notify you of a product or subsequent Promotion that we think may be of interest to you.  If you no longer wish to receive information about products or Promotions, you may opt out of receiving further information by clicking on the “Unsubscribe” link included in such e-mails.  Please also note that if you win a Promotion, some of your PII may be disclosed on a winners list as required by law.

6. Privacy

Wilderborne LLC’s Privacy Policy applies to use of this Site, and its terms are made a part of these Terms of Service by this reference. Additionally, by using the Site, you acknowledge and agree that Internet transmissions are never completely private or secure. You understand that any message or information you send to the Site may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.

7. Disclaimers

WILDERBORNE LLC DOES NOT PROMISE THAT THE SITE OR ANY CONTENT, PRODUCT, SERVICE OR FEATURE OF THE SITE WILL BE AVAILABLE, ERROR-FREE, OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT YOUR USE OF THE SITE WILL PROVIDE SPECIFIC RESULTS. THE SITE AND THEIR CONTENT ARE DELIVERED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND. ALL INFORMATION PROVIDED ON THE SITE IS SUBJECT TO CHANGE WITHOUT NOTICE. WILDERBORNE LLC CANNOT ENSURE THAT THE SITE, INCLUDING, BUT NOT LIMITED TO, ANY FILES OR OTHER DATA YOU DOWNLOAD FROM THE SITE, WILL BE FREE OF VIRUSES OR CONTAMINATION OR DESTRUCTIVE FEATURES. WILDERBORNE LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WILDERBORNE LLC DISCLAIMS ANY AND ALL LIABILITY FOR THE ACTS, OMISSIONS AND CONDUCT OF ANY THIRD PARTIES IN CONNECTION WITH OR RELATED TO YOUR USE OF THE SITE. YOU ASSUME TOTAL RESPONSIBILITY FOR YOUR USE OF THE SITE AND ANY THIRD-PARTY CONTENT. YOUR SOLE REMEDY AGAINST WILDERBORNE LLC FOR DISSATISFACTION WITH THE SITE OR ANY CONTENT IS TO STOP USING THE SITE OR ANY SUCH CONTENT. THIS LIMITATION OF RELIEF IS A PART OF THE BARGAIN BETWEEN THE PARTIES.

8. LIMITATION OF LIABILITY

UNDER NO CIRCUMSTANCES ARE WILDERBORNE LLC, ITS OFFICERS, DIRECTORS, AFFILIATES, OR LICENSORS LIABLE TO YOU FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DIRECT, INCIDENTAL, INDIRECT, PUNITIVE, EXEMPLARY, RELIANCE, OR CONSEQUENTIAL, OR SPECIAL DAMAGES WHETHER OR NOT FORESEEN, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA) ON ACCOUNT OF YOUR USE, MISUSE, OR RELIANCE ON THE INFORMATION AND SERVICES AVAILABLE ON THE SITE. THIS LIMITATION OF LIABILITY SHALL APPLY TO PREVENT RECOVERY OF DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM ANY CLAIM RELATING TO THESE TERMS OF USE OR THE SUBJECT MATTER HEREOF, WHETHER SUCH CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY EVEN IF WILDERBORNE LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Rights to Terminate Use

Wilderborne LLC will retain your data in accordance with its Privacy Policy.  Be aware that these Terms of Service, to the extent any provisions by their nature will survive any expiration or termination of these Terms of Service, shall so survive.

You agree that Wilderborne LLC reserves the right, without prejudice to its other rights, to suspend or terminate your use of the Site at any time where Wilderborne LLC has determined, in its sole discretion that the use of the Site by you is, or was, in breach of these Terms of Service. ACCORDINGLY, IN ITS SOLE DISCRETION, IN ADDITION TO ANY OTHER RIGHTS OR REMEDIES AVAILABLE TO WILDERBORNE LLC AND WITHOUT ANY LIABILITY WHATSOEVER, WILDERBORNE LLC AT ANY TIME AND WITHOUT NOTICE MAY TERMINATE OR RESTRICT ACCESS YOUR ACCESS TO THE SITE.

You also agree that any violation by you of these Terms of Use may constitute an unlawful and unfair business practice and cause irreparable harm to Wilderborne LLC, for which monetary damages would be inadequate, and you consent to Wilderborne LLC obtaining any injunctive or equitable relief that Wilderborne LLC deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies Wilderborne LLC may have at law or in equity.
